Section 22.1-289.012 of the Code of Virginia requires all commissioners of revenue or other local business license officials to report to the Virginia Department of Education, on a semiannual basis, the name, address, and contact information of any child day center or family day home to which a business license was issued, including new licenses and renewals. This requirement was originally enacted in 2015 but as of July 1, 2021, all child day programs were transferred to the authority of the Virginia Department of Education. The following definitions may assist your office in determining whether a program is a child day center or a family day home: 

• A child day center is a child day program offered to two or more children under the age of 13 in a facility that is not the residence of the provider or of any of the children in care, or 13 or more children at any location.  

• A family day home is a child day program offered in the residence of the provider or the home of any of the children in care for one through 12 children under the age of 13, exclusive of the provider's own children and any children who reside in the home, when at least one child receives care for compensation.  

• A child day program is a regularly operating service arrangement for children where, during the absence of a parent or guardian, a person or organization has agreed to assume responsibility for the supervision, protection, and well-being of a child under the age of 13 for less than a 24-hour period. 

Reports are due to the Virginia Department of Education on February 1 and August 1 each year, and shall include the following information: 

• Child care business licenses (new and renewed) issued in the previous six months. 
•  Business name, address, phone, email, and contact information of the individual to whom the child care business license was issued and a description of the child care business to be operated.

• Contact information for the reporting locality. 

Local business license officials and commissioners of the revenue are permitted to use their own report format or the Department’s preferred Child Care Business License Report Form.
